Welcome to SortGuru, operated by EWF Technologies Pty Ltd ("SortGuru", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
2. Spotify Integration
To use the Service, you must connect a valid Spotify account. By doing so, you grant SortGuru access to specific Spotify data as permitted by the Spotify Web API. Use of Spotify data is governed by Spotify’s Developer Terms, Terms of Use, and Privacy Policy. You also agree to abide by all Spotify Terms and Conditions and must not use SortGuru in any way that breaches Spotify’s Terms of Use.
3. Use of the Service
SortGuru provides music organization tools that analyze your Spotify data and generate customized playlists based on your input. Any use of the Service that results in a breach of Spotify’s Terms of Use will also be considered a breach of these Terms.
You may not:
- Use the Service to infringe on third-party rights or violate laws
- Disrupt or compromise the security or functionality of the Service
- Attempt to access other users' data without authorization
4. Payments & Billing
Payments for services are processed securely by our third-party payment provider, Paddle. Paddle acts as the Merchant of Record for all transactions. By purchasing a service through SortGuru, you agree to Paddle’s Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms
Pricing is based on the number of songs processed and playlists created. Charges are clearly displayed before you confirm your purchase. All fees are charged in [Insert Currency] and may be subject to local tax where applicable.
All purchases are final unless otherwise required by applicable law. If you believe there is a billing error, contact us at support@sort.guru.
5. Refunds
We generally do not offer refunds after services are rendered, as our analysis and playlist generation is a digital, custom service. However, if you encounter a technical issue or a problem with your purchase, please contact support and we will review your request in good faith.
6. Account Termination
You may revoke SortGuru's access to your Spotify account at any time through your Spotify account settings. You may also request deletion of your SortGuru account and associated data by contacting us.
We reserve the right to suspend or terminate your access to the Service if you violate these Terms or engage in behavior that harms the platform or its users. Termination may also occur at the request of Spotify, or if your use of the Service causes you to breach Spotify’s Terms and Conditions.
7. Intellectual Property
The SortGuru platform, website, and all content (excluding your Spotify data) are the intellectual property of EWF Technologies Pty Ltd. You may not copy, reproduce, or redistribute any part of the Service without express written permission.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet your expectations. We disclaim all warranties to the fullest extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, EWF Technologies Pty Ltd shall not be liable for any loss or damages of any kind, including but not limited to direct, indirect, incidental, consequential, special, or exemplary damages, or loss of data, profits, goodwill, or other intangible losses, arising from or relating to your use of the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your data.
11. Modifications to These Terms
We may update these Terms from time to time. Changes will be posted on this page and reflected in the updated date. Continued use of the Service after updates constitutes your acceptance of the new terms.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law principles.
